FIACONA Expresses Serious Concern Over Maharashtra’s Proposed Anti-Conversion Law

The Federation of Indian American Christian Organizations of North America (FIACONA) expresses deep concern over the recent approval by the Government of Maharashtra of a draft anti-conversion bill titled “Dharma Swatantrya Adhiniyam 2026.”

The draft legislation, approved by the Maharashtra Cabinet on March 5, 2026, seeks to regulate religious conversions by introducing stringent provisions intended to prevent so-called “forced” or “fraudulent” conversions. While protecting individuals from coercion is important, FIACONA believes that several provisions in the proposed bill raise serious concerns regarding religious freedom, constitutional rights, and personal privacy.

According to reports, the proposed law requires individuals intending to change their religion to provide up to 60 days’ prior notice to government authorities. Such requirements risk creating an environment of state surveillance and social intimidation, potentially discouraging individuals from exercising their fundamental right to freedom of conscience.

The bill also reportedly includes broad and ambiguous definitions of terms such as “inducement,” “allurement,” and “pressure.” Without clear legal safeguards, these provisions may be vulnerable to misuse, enabling false accusations against religious minorities, pastors, social workers, and individuals involved in voluntary interfaith relationships or marriages.

In addition, the proposed legislation includes severe criminal penalties, ranging from 7 to 14 years of imprisonment, and 10 to 20 years or even life imprisonment in cases involving women, minors, or members of Scheduled Castes and Scheduled Tribes. FIACONA believes that such harsh provisions, if misapplied, could contribute to increased harassment and legal persecution of minority communities.

FIACONA also notes with concern that over 30 civil society organizations and several church leaders have already voiced opposition to the bill, highlighting the lack of broad public consultation before its approval.

As an organization committed to human rights, religious freedom, and democratic values, FIACONA respectfully urges lawmakers in Maharashtra and across India to ensure that any legislation addressing religious conversion fully respects the constitutional guarantees of freedom of religion, belief, and personal choice.

FIACONA calls upon policymakers to:

– Engage in transparent consultations with civil society, minority communities, and legal experts before enacting such legislation.
– Ensure that laws intended to prevent coercion are carefully drafted to prevent misuse and protect fundamental rights.
– Uphold the spirit of religious liberty and pluralism, which are foundational principles of India’s democratic framework.
